No, you are not allowed to use Form I-751 to request a removal of conditions on residence if you are an entrepreneur. United States Citizenship and Immigration Services requires that business investors file Form I-829 instead of Form I-751. Officially, Form I-829 is called Petition by Entrepreneur to Remove Conditions on Permanent Resident Status.
If you still file Form I-751 as an entrepreneur, USCIS will refuse to process your application. You will lose the money you paid for filing the form.
Can I file Form I-751 petition online?
No, USCIS does not allow conditional permanent residents to file Form I-751 online. All Form I-751 applicants must download the petition from the USCIS website, print the petition, and fill it out manually. Can I travel if I have already filed Form I-751?
Once you file the I-751 petition to remove conditions on residentship, USCIS will automatically extend your United States residentship for typically a year. Thus, you can travel outside the United States as a permanent resident. Still, there are several recommendations that you should follow to avoid any troubles while traveling:
- Avoid traveling until you receive Notice of Action (Form I-797) from USCIS
- Travel with your valid passport, expired conditional green card, and Form I-797
- Note that it takes at least two weeks for USCIS to mail you Notice of Action. We strongly recommend you to receive the notice and only after that, take your trip. You should also avoid trips that last for several months while Form I-751 is being processed.
